Paxil Lawsuit Notification

Paxil Lawsuit News – 5/11/2012: Please contact us today if you took Paxil and suffered unusual side effects or other injuries.

Paxil Lawsuit: Paxil birth defects unfortunately happen more often than wanted. Studies have suggested that women who take Paxil during pregnancy significantly increase the risk of giving birth to a baby born with a Paxil birth defect. These defects include heart malformations such as atrial and ventricular septal defects and in some cases persistent pulmonary hypertension. As a result of babies being born with these heart defects, there are couples who have filed a Paxil birth defect lawsuit. In Philadelphia, the parents of a child born with severe heart defects are suing GlaxoSmithKline. The parents claim that the mother’s use of Paxil while pregnant caused their child to have injuries. The parents believe that their son, now two years old, was born with severe side effects from Paxil, that included heart defects, as a result of being exposed to Paxil while in the womb. The complaint asserts that GlaxoSmithKline knew or should have known about the negative Paxil side effects concerning the increased risk of congenital heart defects. According to the plaintiffs, the child has undergone three open heart surgeries and now has to have a pacemaker. The parents state that as the child continues to grow, more heart surgeries will be needed to replace a conduit and to insert artificial replacement valves in the heart. The pacemaker will also need to be maintained, and he is at risk for having a heart transplant later in life. The plaintiffs will seek compensation for negligence and negligence per se, negligent pharmaco-vigilance, failure to warn and break of express and implied warranty.

The Paxil attorney representing GlaxoSmithKline states the manufacturer conducted an analysis and found babies were at a significantly increased risk for congenital malformations when their mothers took Paxil compared to other antidepressants and then sent a “Dear Doctor” letter to inform physicians and healthcare professionals about the results. A ruling has yet to be made in this case. This is just one example of a Paxil lawsuit that was filed. If you have become a victim of adverse effects of Paxil, contact a Paxil birth defects lawyer.

EPA Grant to Help Remove Asbestos From Oklahoma Schools

The Environmental Protection Agency (EPA) has awarded a grant to the Oklahoma Department of Labor (ODL) to help with the process of removing asbestos from state schools that have been increasing the mesothelioma risk of students and teachers for decades now.

Asbestos Law Firm: The EPA announced this week that the ODL will receive the $234,713 as a means to help reduce asbestos exposure in schools. The funding will be used for inspections, and to allow for schools to properly comply with the state’s Asbestos in Schools Program, which the EPA details as a program that is “designed to protect the health of school children and other occupants as well as the community.”

More specifically, the ODL will use the funding to complete 100 audit inspections in state schools throughout the year, while also verifying that asbestos workers who perform abatement work are properly trained and accredited.

Asbestos was commonly used in the construction of schools for much of the 20th century. While asbestos abatement work continues to reduce the amount of asbestos in school buildings today, students and teachers are still exposed to dangers levels of the fiber and be more likely to develop mesothelioma later in life.

High School Basketball Player Not Held Back By Erbs Palsy

Landus Anderson is one of the top high school basketball players in Florida and has aspirations to one day play basketball in college and beyond. All the more impressive is that he accomplishes everything he does on the court with only one hand due to the fact that he has Erb’s Palsy.

According to the Fort Wayne Journal Gazette, the 6-4 junior who has averaged more than 19 points and eight rebounds a game for the Florida High Seminoles has no control of his fingers on his right hand. Similarly, his right arm can hardly be used in competition either. While some children diagnosed with Erb’s Palsy can recover range of motion in their arm by their first birthday, such was not the case with Anderson.

Cerebral Palsy: “They can’t fix the damaged nerves, but at birth I had a muscle transfer in my bicep area,” said Anderson, who is almost a straight-A student as well. “They could’ve done one down low, but my mother didn’t want them to experiment on me.”

Despite his birth injury, Anderson has learned through the years to accomplish everything from the most simple skills (tying a shoe) to more complicated ones (playing basketball) with the help of his family.

“He has a determination that’s so unique,” his mother Pamela Anderson told the Journal Gazette. “He’s not a complainer. He’s not a whiner. It wasn’t easy, but Landus made it easier.”

While a birth injury such as Erb’s Palsy can be very difficult with, it is possible for people with the condition to live regular lives. If you have a child who was born with a birth injury that may have been cause by medical negligence, contact Sokolove Law today to learn more about possibly pursuing a birth injury lawsuit.

Yaz Settlement News

Yaz Settlement: Both the bladder and the urethra need estrogen in order to stay healthy. Without estrogen, the cells that line the inside of the bladder and urethra become thinner and less elastic. After menopause, the ovaries make very little estrogen. After months or years without adequate amounts of estrogen, these areas generally don’t function as well as they once did. Also, the lining of the bladder can become more easily irritated by substances in the diet that are filtered into the urine, such as from caffeine, alcohol, citrus fruits, carbonated beverages, or spicy foods. Therefore, menopausal women who are not taking estrogen replacement may notice a worsening of their bladder symptoms over time.

The nerves that carry signals to the bladder also need estrogen to work properly. Without estrogen the nerves may become so sensitive that you may experience urgency or have bladder spasms after even partial filling of the bladder. If this condition worsens, spasms can cause leaking. Taking estrogen allows the nerves controlling your bladder to function properly and helps prevent these spasms. Sometimes a combination of estrogen and another means of decreasing spasms, as described in this chapter, maybe needed to relieve the symptoms.

There are a number of ways to get estrogen to the tissues of the bladder and urethra. Probably die fastest way to get estrogen to these tissues is to use a vaginal cream with estrogen. The cream is inserted with an applicator at bedtime two to seven times a week, depending on how much estrogen the tissues need. Given in vaginal cream form, the estrogen’s effects are focused on the vagina, bladder, and urethra. However, some of the estrogen is absorbed into the bloodstream and will reach the rest of your body. If you use an estrogen cream every day for more tiian a few months, you shoidd also take progesterone to prevent overgrowth of the uterine lining cells (unless you have had a hysterectomy). With a higher dosage and daily use, estrogen in die form of a vaginal cream can afford the same protection to die heart and bones that oral estrogen does.

High School Wrestler Overcomes Cerebral Palsy

Children who have sustained birth injuries often go on to do remarkable things. Andrew Dubowsky is an example of this phenomenon.

Dubrowsky is an ambitious high school freshman from Kearney, Nebraska. who was born with cerebral palsy. Despite his condition, he has worked his way onto his high school’s wrestling team.

Cerebral Palsy Lawyer: Because he was born with cerebral palsy, Andrew has limited ability to use his legs and is mostly confined to a wheelchair. He has yet to win a contest, but nonetheless he is undeterred. He recently told a reporter from Nebraska ABC affiliate KHGI-TV that he has aspirations of winning the state championship by the time he graduates.

For children with disabilities, organized sports can often seem like a goal that is difficult to achieve. Andrew always wanted to play football, but couldn’t because of his lack of mobility. Wrestling, on the other hand, doesn’t require the same sort of physical requirements.

Many individuals with birth injuries such as cerebral palsy have been able to find success in this sport when competition seemed otherwise daunting. In 2011, the NCAA wrestling championship was won by Anthony Robles, who was born with just one leg.

“This sport offers a lot of things and I think that Andrew was just trying to do something with himself,” said Melissa Dubowsky, Andrew’s mother.

Cerebral Palsy Malpractice: Even though Andrew faces a tough road toward achieving his dreams of a state championship, he has already attracted the attention of other coaches and wrestlers in the area.

“The Seward coach came up to me after my first competition and told me that I inspire his kids because of the way I wrestle,” Andrew said.

It’s so exciting for us to see children with birth injuries overcome their conditions. His story is empowering and uplifting to all of us. There are many opportunities for these kids to excel, whether that’s in sports or in other activities. If you have a child who was born with cerebral palsy, call Sokolove Law today to learn more about potentially pursuing a birth injury lawsuit.

Hitting A Home Run Sports For Children With Birth Injuries

Your child with cerebral palsy may have physical limitations, but that doesn’t mean he or she has to sit around the house and remain inactive. With increased activity, many children can build endurance, muscles, social skills, more independence, and better overall health.

Conversely, reduced activity can limit the stamina of a child with a birth injury. It can also contribute to a lowered self-esteem and lead to medical issues such as bone loss, poor circulation, and blood clots.

Cerebral Palsy Attorney: If your child is currently not physically active, experiment with a variety of activities to see if there are any that he or she naturally gravitates toward. Events like the Special Olympics accept children who were born with birth injuries and can often open your child’s eyes to a variety of activities in a safe environment. Look for groups, summer camps, after school programs and other organizations online that offer activities for disabled children. This is also a great way for you to meet other parents of disabled children; you can share stories and develop friendships.

Many parents believe that children with disabilities are more likely to get hurt if they participate in sports or recreation programs. However, disabled children have the same risk as other children when it comes to physical activity in most circumstances. Talk to your doctor about any concerns you may have over injuries to your childen, he or she can reassure you and suggest sports or activities that would be the best.

Cerebral Palsy Law: As a parent of family member of a child with a birth injury, your goal is to create a normal and happy life for your child. Whether it is sports, school, or socializing, you want what’s best for their development no matter what the cost.

That being said, the financial burden can be overwhelming at times. If you think your child’s birth injury was caused by medical error, call Sokolove Law today to learn more about pursuing a birth injury lawsuit. Monetary compensation in a birth injury lawsuit can be designated specifically towards medical costs for your child.

Yaz Settlement Notice

Yaz Settlement: Some women try medications and exercises for relief of incontinence but are still plagued by bothersome symptoms. For these women, surgery may provide much-needed relief. Surgery is most effective when stress incontinence is a major part of the problem, and it may help if some urgency accompanies stress incontinence. It is not likely to be effective for pure urgency or urgency incontinence. One of the goals of surgery for die treatment of incontinence is restoring the bladder and urethra to their normal position. Most women who have given birth vaginally have some degree of loosening, stretching, and even tearing of the supporting ligaments of the vagina, bladder, and rectum (see Chapter 4). This weakening of the supporting ligaments usually begins unnoticed and without any symptoms and remains that way for the majority of women for tiieir entire lives. But for some women, the changes that occur as a result of the lengthening and stretching cause significant incontinence that interferes witii their daily lives.

An abdominal bladder suspension operation is performed in the hospital with anesthesia, either epidural or general (that is, you’re put to sleep). We often find that, in addition to repairing the bladder, other reparative surgery of the supporting structures of the vagina and rectum may be necessary. Happily, it can all be performed at the same time. The bladder suspension procedure itself takes about one hour. Most women spend about two to three days in the hospital, usually because they need pain medication to help with the discomfort from the bikini incision. Most doctors leave a catheter in the bladder for a few days, or even weeks, after surgery to help drain the bladder until you are able to urinate easily.

Since the abdominal incision needs time to heal, some activity is restricted. For die first week, you can get up for meals, go to the bathroom, and take short walks. You will be fatigued, and simple activities will make you tired. After the first week you will feel stronger, be able to take longer walks, and need less rest. After about two weeks, some women begin working again from home. A few who can’t avoid it go to work for a few hours a day. It takes about six weeks for most of the healing to take place. Most doctors recommend that you not do any exercise or lift anything heavier than 15 pounds for three months. This allows the formation of strong scar tissue that will hold the bladder in die proper position. After surgery, you probably should never lift anything heavier than 25 pounds. You don’t want die force of lifting to stretch and weaken the repair work.

The laparoscopic Burch is performed through small incisions and has the advantages of less postoperative discomfort and a faster recovery. However, the procedure requires special training and skills on the part of your doctor, and not all gynecologists perform it. The laparoscope is a small telescope that is passed through a 72-inch incision in the navel . Two or three smaller (74-inch) incisions are made above the pubic hairline and the operating instruments are placed through these incisions. The telescope and operating instruments are placed into the space around the bladder and specialized instruments are used to place the sutures to suspend die bladder to die ligaments near the pubic bone, just as in die Burch procedure.

Massachusetts Attorney General Charges Two With Improper Asbestos Removal

A property owner and the heating contractor he hired to work on a rental property are being charged with allegedly removing dangerous asbestos products illegally and violating the Massachusetts Clean Air Act in the process.

Asbestos Law Firm: According to a press release from state Attorney General Martha Coakley, 58-year-old David Einis hired 41-year-old Nicholas Pasquantonio to replace a boiler at a Medway, MA property he owned. Pasquantono was not a licensed asbestos contractor.

While working at the property, Pasquantonio did not properly seal the basement while he worked with products that contained asbestos. Additionally, Einis and Pasquantonio never obeyed clean air laws by notifying the state that they had disturbed asbestos products during the renovation.

The Medway Board of Health eventually learned of the illegal asbestos work taking place on the property and notified the Massachusetts Department of Environmental Protection (MassDEP), which sent officials to inspect the site and allegedly found that improper removal and release of asbestos had taken place.

Einis and Pasquantonio were each eventually indicted on two counts of failing to file a notice of asbestos removal with MassDEP and failure to prevent asbestos emissions.

Yaz Side Effect Info

Yaz Side Effect: As every woman who delivers a child knows, labor and delivery subject the body to forces that are not encountered in any other circumstance. The muscles and nerves in the pelvis are especially affected. As the baby’s head comes down into die pelvis, it presses against the muscles that line the inside of die pelvis. The farther down the baby’s head goes into the pelvis, the greater is the pressure against these muscles and underlying nerves. After the cervix is totally dilated, the pushing phase of labor begins. The mother is usually asked to wait for a contraction to start, then hold her breath and bear down as hard as she can in order to push the baby out. This bearing down presses the baby’s head against the mother’s muscles and nerves to such an extent tiiat the normal flow of blood is cut off temporarily, until that push is over. Without a fresh supply of blood, the tissues are deprived of oxygen and nutrition, making them more susceptible to damage. The pressures generated by pushing are three times as high as the tissues would normally tolerate for any prolonged time. However, the few minutes of rest in between contractions usually lets blood flow back to the area. This fresh blood carries oxygen and nutrition to the muscles and nerves and carries carbon dioxide and waste materials away. The several minutes between contractions are normally enough for die tissue to recover.

However, unless delivery occurs quickly, the baby’s head continues to press against the tissues with each contraction. For some women this pressure can cumulatively add up to many hours. Two nerves, called the pudendal and the pelvic nerves, lie on each side of the birth canal witiiin the muscles that are direcdy under the baby’s head. Because they are so close to the baby’s head, these nerves are especially vulnerable to the pressures of labor. The pudendal and pelvic nerves carry die signals from the brain to the muscles that hold the bladder and rectum in place.

Some recent studies show that the likelihood of incontinence and prolapse is lower if the mother (and her doctor) allows the natural force of the uterine contractions to push the baby down the birth canal, rather than the mother pushing as hard as she can during this time. Studies show that if the voluntary pushing part of labor can be limited to less than an hour, there is a lower incidence of injury to the nerves and muscles of the pelvis. This alternative may be a safer and more natural way to deliver. Let the uterus do the work it was designed to do.

New Mexico Waste Site Took In Asbestos Products

Asbestos fibers can be extraordinarily dangerous and harmful to our health when released into the air. The main danger associated with the toxic fibers comes from the illnesses they can cause when inhaled into the lungs, such as mesothelioma, asbestosis and other forms of cancer.

Asbestos was used in American building projects as well as in a variety of other applications from the middle of the 19th century to today, although its use waned in the 1970s and 1980s. Because so much of the material was processed and consumed over this period of time, many construction products that contain it still remain in buildings – from offices and warehouses to private homes and restaurants. Oftentimes, the people who live or work in these structures do not even realize that they are at risk of asbestos exposure.

Mesothelioma Treatments: In the state of New Mexico, where asbestos-related illnesses remain a significant issue, the Eagle Rock Convenience Center was recently found to be taking in old asbestos tiles. According to Claims Journal, the products should have been disposed of in safer and more appropriate manner than simply being left with industrial garbage in order to keep asbestos fibers from being released into the air.

Fortunately for the people of New Mexico, a worker at the facility discovered the asbestos tiles and reported the dump to authorities. who required the dump to remove the hazardous asbestos and dispose of it properly.

While this case in New Mexico was seemingly rectified before too many people were exposed to the loose asbestos materials, we can only guess how many municipal garbage dumps across the country have asbestos materials illegally sitting in in them that could pose a serious risk to the communities located nearby.
